Biography

Toby is a Partner in SDV Fenchurch’s Singapore office. Toby focuses on high-value and complex insurance disputes of all kinds including, in particular, disputes relating to Construction, Engineering and Marine risks.

Toby has a breadth of experience acting for international clients seeking representation and coverage advice in relation to a wide variety of policy types, including Construction All Risk, Professional Indemnity and Third-Party Liability policies. Toby’s practice also includes coverage disputes in the Marine and Shipping sector focusing predominantly on first party loss claims under H&M, Cargo, or War Risk Policies.

Toby’s focus is on developing the firm’s presence in the wider APAC region, providing support to policyholders and brokers.

Experience

Toby advises policyholders, contractors, developers and investors on complex construction, engineering and marine insurance disputes. He has extensive experience handling high-value claims involving property damage, business interruption, delay in start-up, professional indemnity and third-party liability insurance across a range of sectors and jurisdictions.

His recent experience includes advising a major UK main contractor on the recovery of approximately £170 million arising from damage to the largest flat timber roof in Europe during construction. He has also acted for a utilities contractor in relation to a Construction All Risks claim concerning damage to a major water pipeline in Scotland and advised a global investment firm on losses arising from Covid-19-related construction delays across multiple projects in Ireland. Toby has further acted in connection with losses affecting power generation, renewable energy and industrial projects across Asia, including matters involving power stations, hydroelectric facilities and specialist construction equipment.

In addition to his construction and engineering practice, Toby has significant experience in marine insurance disputes. He has advised cargo owners on a US$10 million claim arising from cargo substitution and theft, acted on disputes concerning damage to undersea cables during offshore construction works, and represented a container leasing company in insurance-related proceedings.

He also regularly advises insurance brokers and commercial clients on cargo insurance claims, with particular expertise in policy interpretation, aggregation, causation and recovery issues.
